Sorry, no. As Art does not hold the copyright, he cannot do anything about it unless he were to sue over his name being used. The most that could be done on Arts behalf is the site taking the shirt down due to complaints. Look at the Obama hope poster. Obama doesnt own it, the artist does.

I never said sue either, I said he should issue a cease and desist letter.
If the artist were to sell prints then Art could go after him but he does not seem to be doing that.
The artist repurposed an Ian Allan Photo but it does not make the final product his, the original source material is still Art Bell's.

copyright law states that if you change the original photo to a certain extent, you own the work. If his last name were not on the shirt, Art would not have a case at all, whether a lawsuit or a simple cease and desist. Feel free to contact a copyright lawyer to prove me wrong. I spent nealy two years trying to sue someone who stole a lot of my artwork, made prints, and sold them. Copyright laws, especially laws pertaining to pictures on the internet, are not as cut and dry as you thinmk they are.

Opinion:
The person who made the image Falkie is using could obviously stop him since he or she owns the copyright on it. Since Art is a public figure he has something called Right to Publicity which means he has the right to his own image for use in the sale of promotional items and if someone's else uses a celebrities image it should be licensed so Art could stop him as well. With Obama it was a different story possibly because politicians release images of themselves into the public domain, especially the White House.
Art losing the rights to his image if he doesn't protect it is trademark law so that's not applicable here.

The person he is stealing from is the artist who created that image. The picture would be considered fan art if anything, and Art would not be able to sue.
