Only if every song they play is administered by Harry Fox, right?
Otherwise they need a compulsory license.

Also, if they go after them it would not be for the $7,280. They will claim willful copyright infringement and go for $150,000 for each unauthorized use.

D+  what you go on about now MV BartieBoy?

Music licensing is very complex. So far as I know Harry Fox would handle licensing the sale of all of the music Art used.  The copyright is owned by the publishers and they would have separate actions for copyright violations, especially if LNM network was not paying ASCAP and BMI.
The RIAA could also get involved.
All of this dates from the early 1900s when record companies and radio stations worked out how to monitize music. It doesn’t necessarily make sense.

I knew a guy who somehow inherited "rights" to this song..He would get a few thousand dollars a year.

The key thing is that even with the head start in infrastructure she had with Keith, it seemed the goal was to hang onto an ever dwindling subscriber base. She doesn't have the ability to actually build a program on her own merits. Keith is already the winner, as I bet now subscribers grow under Dave's reign and it becomes about expansion, and not retention.

Yep

Has it ever occurred to you that you have some type of unnatural antipathy toward a person who's only "contact" with you has been over a podcast?

I'm just curious who deputized you to be the Rober Mueller of bumper music?

:o

I have a great deal of interest in music rights payments after I got a report four pages long showing plays of my song on a Viacom network with no money being paid.

So, your interest in trolling, doing recon for Heather, huh?

As long as she opens her mouth, she keeps getting deeper into the boiling pit of sewage. Is she hoping that people forget her actions and promises?  She's paranormal talk's version of Hillary Clinton.

... Personally if I was Keith I’d just ignore her and let her fail on her own. What is Keith’s motivation for attempting enforce a noncompete it at this point from a business standpoint? If he legally stops her from doing her shitty show will her band of nutjob listeners start listen to Dave Schrader? No. Let her her go and move on...

I think if he can return some of the grief she's given him, and cause her to either re-name her show or be wiped out from legal fees - with minimal legal costs on his end - he should do so.

In reading some of the HW fan posts on Facebook about the LNM Radio announcement I am amazed by the number of "you go, girl" comments.   ???

HW has that many people interested in her return ?  Really ?

I also like the comments asking if she'll be streaming on Joe M's shatshow network as well.  Umm, maybe I missed it but it seems like she dumped him, HW fans.

I am somewhat surprised by the number of alleged fans.  I'd rather listen to Good Dave, Clyde, JBW, Bad Dave and cats in heat.  Oh, and my first choice is still "Somewhere In Time".

I don't get the HW fandom.

It kinda siunds like a crowd yelling JUMP! to someone on a ledge. .. 😆

So, who's going to be sending pictures of their junk to HW's listener submitted photos on her fab new website?

While I get the "let her hang herself" sentiment, I seriously want to ask..

If this were a fill-in host for Art we were talking about, and not someone who he chose himself to take over MITD, would there even be a question as to what Keith should do about this?  What should Keith do if some crazy chick (or guy, for that matter) who really had no business taking the name, the music, the subscribers..  walked off and declared themselves the Legacy?  Should Keith just roll over and let it happen? He's trying to keep some legitimacy to not only MITD, but to his own network.  I don't know what else he does for a living, but I'm sure he spends an inordinate amount of time on this.  Shouldn't he stand up for himself? For what Art envisioned?

The thing is, then she has a scapegoat-

In her particular situation, having drama, having a personified 'satan' figure (Keith) and creating tribalism and an 'us against them' mentality will actually work to her benefit in my opinion.

Shes going to a network where nobody is making any money in an 'industry' where almost nobody is even making as much cash as a part time Mcdonalds job and yet dealing with stress and hard work and crazy people- Shes already reached the pinnacle of what she will ever achieve.

I agree that Keith should just let her fail (and fail she will) without being able to point fingers at the 'unholy one' or giving an enemy for her troops to rally behind. She expects to make a living doing this and she was making a living but now reality is ready to bite her in the ass- Theres no money in this and the people doing it have to resort to beg-a-thons to even cover their internet costs.

Sad but true- Shes not going to last unless she enjoys rthe stress of semi-celebrityhood without the benefit of being able to afford a bag of weed without having another means of support.

No- In my option he should just let them fall on their own.

Nobody has a monopoly on the "legacy" of Art Bell anyhow- Even Keith... Its so silly to be fighting over the anointed one position. Sink or swim on your own merits.

I think MITD should have been retired as a name and a show but someone pointed out that they would have to probably end all subscriptions if they did that which is logical..But this whole thing is really petty.

To put it in ghetto speak- This is a bunch of studio gangstas acting tough over nickle and dime shit.

Why?  The drama that she has brought has certainly reinvigorated his show and raised the value of his network.  If she had just stepped aside quietly do you honestly believe that this board would be buzzing- that social media would care that DS is now hosting MITD?

She has actually done him a hell of a favour- so why be petty?  Thank her, move on and let her broadcast to her few fans.  Unless he is actually worried that she is a superior broadcaster offering a superior product it should not matter if she in one of the 100,000 podcasts out there in competition with him.  It's also not like her fans will be returning to the fold and handing Keith their $60 / year if she is forced out.

I'd let her out of any non-compete, but she shouldn't be going around dissing Keith or stealing his intellectual property.

Yeah I agree.

And like WORT just said, the drama may be helping everyone involved right now- But its all short lived.

It is entertaining though.

Sean92008

All the trolling sycophants (and probably Heather Leona Wade herself) here on BellGab have solidified my motivation to place those calls to the performance and recording organizations.  I'll enjoy the opportunity to talk shop in any follow up calls.

I don't mind being part of their self-imposed karma.  The entertainment value is wonderful.

Heater dear, keep digging. Ignoring logic is a skill you have mastered.  Your minions aren't cute and yellow, they're just helping dig your hole deeper.

As DP pointed out, she is creating a tribal mentality.  But that is working in Keith's favour as well has hers.  It is getting people to solidify their positions and an number are behind Kieth in a way that I don't think they otherwise would be.  I don't think that you can discount what her crazy has done to help Keith's "brand" and network over the last month.  He should be paying her a retainer to keep on doing what she has been and acting how she has since Art's death.  It would be worth it.

That about sums it up.

SO, in your estimations (yours, DP's, etc).. how much of this on Keith's end is about:

a) money- He doesn't want Heather to take subscribers away from him, because it means less income (and I doubt there was much anyway).
b) business- He's got a network to run, and she was the flagship show, and now what's the point of doing any of it (even though other shows are on there).  Gotta fight for it.
c) loyalty- Art's his friend, and he's trying to do what he thinks would honor their friendship, or Art's wishes
d) legacy- he thinks he should be the legacy, and fuck Heather as the legacy
e) all of the above
f) variation of any

Throw reputation in there somewhere.
