Seriously, I think the money (sorry, I forgot who made this point that she's not being paid but needs to sell subscriptions) will be a big issue and pretty fast.  The increased bandwidth that she's supposedly going to draw and the extra downloads from the archives that she's supposedly going to draw will be expenses that Vara may not have thought about/planned for/estimated.  That is, if they're paying proper rights and mechanicals on the music alone.  If Vara is currently out of compliance on the mechanicals, the attention drawn to him could be costly.  During discovery, he would have to supply files going back all ages.  If not, he could be paying for downloads going back to when he started his podcast + damages and legal fees. 

With all that "what if" in my head, I can only follow that by saying that these two deserve each other.

It is within the realm of possibility that Michael thinks he is toying with the mouse...  While unlikely on the surface, he would be putting his network at risk with the exposure of litigation although, I'm sure Vara has some contractual separation (you know, something like Heather Wade is solely responsible for the material she provides).  Since he is providing cover for the music licensing, he's exposing himself.

I have absolutely zero interest in hearing anything she has to say about Art at this point. Or about how she's "the legacy", or about how "Evil Keith" took everything away from her.  She knew Art for how long? Where the fuck does she get off??  >:(

Still not sure how a non compete can apply when she was terminated first. And I'm pretty sure everyone on here who is caught up in threats of legal action against Heather is just jealous. She's probably using her inheritance from Art to fund this and the music. She probably will lose money and won't make a dime. With her I think it's jointly a passion and a vendetta.

Wow...  Earlier I posted that it used to be $0.10 a song for mechanicals.  $0.091 is amazing considering the ease of distribution now.  Of course, many artists are still ripped off by YouTube/Google.

The $0.091 is for downloads.  I think “records” are higher.
The 71-72 limitation came from a lawsuit filed by Flo and Eddie, formerly of The Turtles.  I think it applies to performance rights rather than mechanicals, though I haven’t researched it throughly.

Could be a payout with the non-compete on termination.  She probably refused the cash and thinks that unbinds her.

I doubt she'd get paid out, from everything I've seen and read it appears she broke the contract and Keith terminated her for it.  If Keith had broke it then there may have been language addressing some sort for buyout.  I think she's fucked on the legal end but again, she's got nothing to lose and it will cost Keith tens of thousands of dollars and probably a year (recent experience suing another company) to get a judgement which he will never be able to collect on.  The crazies will send her enough money to get some sort of legal representation that will do nothing but drag out the litigation.  What I'm curious and no nothing about are injunctions and how one might be used in this instance.

I hope Keith files in Arizona...  Heather will either be forced to hire counsel who is licensed in Arizona (which, frankly, is easier in Nevada because of proximity) but these snakes will charge extra for the convenience.  I'd like to joke that she would want to represent herself because she's on a mission from Art.  [Remember, Keith has legal counsel already and all they'd have to pay is a filing fee to get the ball rolling.  After that, she's gotta lay out money.  Unless she inherited some, she's up shit creek.]

There is a real possibility that Keith's already on-board legal counsel might be advising him to let her sink her own ship.  So many of her missteps are on a much larger scale, namely the music rights.

I will personally be contacting the RIAA and Harry Fox and I encourage all of you to do so as well on Tuesday morning.  I'm sure they'd step up an investigation if it weren't just a "crank" or two.

We don't need to do anything but bring attention to the powers that be.  Sit back and watch the shit flow downward.  If she's paying (like claimed) then no harm, no foul.

I personally doubt she is.  There's just no economic feasibility (as shown in posts by myself and Juan in the last 16 hours).  Her business model is using fairy dust, cat sacrifices and possibly a human sacrifice as well.  Unless she's working on her version of Brewster's Millions, she's not living in reality...

Now it's time for me to get the writing bug and come up with a screenplay on the late night paranormal radio wars.  Gabrielle Carteris is my choice for Heather.  I think Gabrielle would be thrilled to be playing a younger woman and, more importantly, I don't want to ruin anybody else's career.  Playing a psycho can lead to industry rejection for future roles less sinister.
