Seems to me if they uploaded it to youtube its now public domain no? as long as you aint selling the video or making money off it etc

Whether or not the dikball video is removed, it is my opinion that it would be proper and fitting to fully inform them of their legal right to take a HiVelocity Flying Fuck.

Caller: Because...apparently, the brothers that made that movie, they liked to mock the state of North Dakota. I don't know.

The caller describes a scene in a bar at the beginning if the film and says:

Last night it was the theory that the Easter Island statues were 'walked' into position. In George's tin foil hat world, it has to be aliens. Along with the pyramids, Stonehenge et al. We descended into this pretty quickly last night, of course. This irritates me on two fronts.
First, it's just an insult to human ingenuity, dedication and skill. It's an awe-inspiring piece of building/engineering, ergo we couldn't possibly have done it. Give it a thousand years or so, and Joorch would be saying the same thing about Chartres Cathedral and the Empire State Building.
Second, these aliens/inter-dimensional beings are supposedly from some technologically advanced civilisation. They'd have to be to get here. And what do they offer? The secret of space/time/inter-dimensional travel? The computer chip? Sliced bread? Nope. Pyramids. Stone circles. And that's it. 'Just build pyramids and henges and you'll be fine. That's where the future is. OK? Have fun and we'll be back in a few thousand to see how you're getting on.' It makes far less sense than the notion that we built them ourselves.

MV, the question isn't whether they have legal grounds to ask for its removal, but if you think they'd really take legal action if you didn't.   I kinda think the answer to both questions is 'no'.

I'll risk joining the Cap'n Obvious brigade, but it's a no brainer, isn't it? If they posted it to YT, they put it in the public domain. What happens after that they have no control over by definition. Millions of links to YT videos must be circulated by email every day. It's how YT works. Gangnam style. Posting a link on a forum is no different, surely. The fact that it may be posted here  for us all to gawp in blank disbelief at the cheap production values and the incompetence of the host might irritate them, but from a legal point of view that surely is irrelevant.

Gaiam must be as dumb as their host.

It's only a titled link to a file that GIAIM posted on YT themselves. Seems they need to sue Yahoo/YouTube. And figure out why things are posted on YouTube. Ooops.

hivelocity says i can file a counter DMCA, but in the meantime the content would have to be removed until the situation is resolved.  pick your battles, for sure.  doesn't this fucking dumb company (gaiam) know that the best way to get people interested in their content is to... uhh... let people see their content?  whatever.
