No. The prevailing legal opinion is the WH lawyers were left to look like they'd just left art college, rather than anywhere that taught law. They were unprepared and even had the judges trying to explain sections of law to them! Don't let yourself believe (though you clearly do) anything Trump says. What astonishes me is that Trump's fan-boys here actually believe _they_ know more about Law than the Federal Judges do -- let alone all the other informed and educated observers, lawyers, scholars, reporters in the U.S. do!  If the Courts had "no authority" to challenge Trump on this matter THEY WOULDN'T/COULDN'T have done so -- end of story!

Yep.  The reason Trump did not appeal it is because we have 4 activist hacks on the Supreme Court too who might well have held up the 9th's opinion.  Better to rewrite the order with the exemptions for green card and visa holders and try again.  Maybe by that time if there is a ruling, Gorsuch will be in place to rule in favor of Trump.  I'm not worried about Kennedy because he is a moderate and will see through the left's attempts to circumvent the law.  Don't worry, pud, the order will stand in the long term.

From what I've read the attorney for Trump was incompetent.  He was some loser left over from the previous administration.  Hardly handpicked. He failed to mention the US code that gives power to Trump to do what he did.  The only thing questionable about the EO was the failure to address visa and green card holders.  Other than that, the judges had no authority to stop the process at all.  Why didn't they do so when Obama banned some immigrants for a time back in 2013?  It is all political because the 9th Circus doesn't like Trump.

What are you not getting?  Trump is rescinding that order because of the green card and visa issue.  The 9th could have merely struck down that part of the order so green card and visa holders would not be affected.  They didn't do that because they have an ideological problem with Trump.  Well guess what, Trump is basically rewriting the EO with exceptions for green card and visa holders.  The rest of the order will basically be the same.  Trump has the authority to do this.  Trump's new order will hold up against court scrutiny in the long term.  The left doesn't have a leg to stand on.
