Malachi.martini:

You may not have ever said the word "liar," that I will admit (though I will not go through your posting history to verify), but the clear intent of your words were to call "BS" on Art when he talked about forces behind the scenes.  I consider it fair to label you as having implied he was lying - how is that to improve my accuracy?

Yes, Babylon 5 was great.  I actually own all the tapes, and even got autographs of many of the actors in the show [head hung].  And besides liking your name, your avatar interests me.  Where is that from, and is that the actor from "From Beyond?" Jeffrey Combs, I believe?  Not sure though.

Context is everything.  It's nonsense to talk about forces behind the scenes, when you left your show for dubious reasons.  (Cellphones!  I don't know anyone with a landline anymore.  My base wasn't there!  Even Opie and Anthony said it's rubbish to say this after only 6 weeks.  Streaming!  There will always be problems with streaming, that is an UNCHANGING variable).  So when he strings us along and points to the inevitable ( something will fill his spot), it's bullshit to parade that around as THE REASON the show isn't happening.  Of course someone was going to take what he left behind, that's why he says, "First of all my sincere congrats to Premiere Radio, they made the right move."  Premiere coming in is absolutely irrelevant to me.  I would have loved to listen to Dark Matter through the holidays, but Art ended it.

My avatar is from a Peter JAckson movie called The Frighteners.  Jeffrey Combs is fantastic in it, but he is in everything. :)

Noory seems to know how to play corporate politics and kiss the right amount of ass. Premiere seems happy with him because he's "safe", not because he puts on a great show.

Noory "gets it."  Noory sucks.  :P

Typhoon tragedy aside...Why couldn't Art just broadcast from the Philippines like he used to and give the NC from Sirius the middle finger. Surely their legal reach doesn't extend that far or does it?

You're asking him to uproot his life in Pahrump to suit our needs?

Wait a moment, I said I would honor the NC, I did not say I would not take Legal action to try and change it.

Prior to that now damndable status bar, I never actually entertained a hope that Art would come back to radio.  That water had not only passed under the bridge, it had made it's way to the ocean.  My one true desire was to see Premiere boot Jorch in favor of someone with talent and intellect.

Perhaps the lamest result of all this is that Premiere now has bonafide proof that they made the right decision in keeping a toady at the mic instead of ever taking a risk.  Snorch is here to stay.

indigoo

I found it odd that Art thinks he'd probably win his freedom by going out and getting a lawyer to help waive the NC, but doesn't think he'll do that. Then a few paragraphs later he says if there's anything to do to get back he will do it. Which is it Art? The indecision is fucking annoying. If you want out, that's fine, and we can respect that decision. But I don't want to be strung along anymore.

I'm sure with some clever lawyering, Art could broadcast over the internet with the host servers being in a foreign country, kind of like how the gambling websites are all off shore but the companies are based here. I doubt it would be all that difficult. He probably could be back up on the air by New Years.

And I spent two hours earlier today going over the damn thread, drawing out factual points and issues, and was going to offer my legal services (for whatever good they are) to Art or Paul to challenge this No Competition ("NC") clause.  Depending on the facts behind the scene, the NC may be beatable in the forum of public opinion.  I do not admittedly know all the facts, who does, but there are hints it may be beatable based on the ongoing stream problem from the beginning, the offer to be an independent contractor by Art, Sirius' refusal or silence on both issues, and then offering the same basic deal to Noory - who they were secretly negotiating with through this entire process according to that bastion of honesty, George Noory.  Also, Art wrote he was off the air by mutual agreement - that may have legal ramifications, depending on what EXACTLY went down, for the word "mutual" implies Sirius was involved in Art's show going off the air. Plus, Art's show overlapped with Noory's on many nights during this secret negotation, which the two parties (Sirius and Premiere) were well aware of. Should a NC clause remain in effect when one party was actively working against you? The claim can be made, at least enough to get into court and let public opinion start to take hold.

There would also have been an actual plan on how to wage a publicity war, since that would have been what really would win a case like this, as well as hints for others to do a class action lawsuit.  The reality of it is any option like that, though "legal," are really an excuse to do a publicity battle with Sirius until they suffered enough to release Art from the NC clause.

Only one problem (well, many of them, but only one insurrmountable one).....Art would have to be on board, and he is clearly not.  While I understand that from a man of 68, without him leading the fight and doing what his attorney(s) say, the effort is useless.

I am going to hurt Sirius how I can, and more importantly Premiere even more, and George "Lying Sack of Shit" Noory even more than that.  The man and his show (that piece of shit is no longer Art's creation) both have no personal or corporate integrity.  I will complain everywhere I can, email Sirius every way I can (and already have), and let them know.  It means nothing now, but it might in the future.  Then I will do the same with Premiere, but also contact all their advertisers and let them know everything I can to get them to listen - mainly tell them that I will never buy their products again if the situation remains.  Ever.

This may well be Don Quixote tilting at wind mills, but hey, I've done it in the past with great personal satisfaction, and I will do it again in this instance.  Art is the artist, and not a politician or a businessman; Noory is the exact opposite.  Snoory may win now, but I refuse to acknowledge him as the winner long term, and will conduct my own personal war against the man and all that he stands for.  And I encourage you all to do the same.  I hope SaucyRossy does good work on a video to get the word out, for the man is a professional! Falkie also has a good idea, buying stock in these companies, to have a voice, and I may buy the minimum amount myself for that reason.

Lastly, I found the people who called Art a liar when he talked about things going on behind the scene to be reprehensible.  They post here, against Art?  I do criticize Art for having no business acumen, but to call him a liar?  While I am a big believer of free speech, and have never called for anyone to be banned (and am not now), I specifically am calling out Uncle Duke, malachi.martini (great name though) and littlechris. You three, at least, should Man-up (their genders are unclear)and apologize for that claim, which was clearly wrong.  You three were flat out wrong, and while I may have missed something in 65 pages of reading, I did not see you apologize for being so flat-out wrong.  Do that, or I (at least) will ostracize you.

Sorry, a lot of venting here mixed in with a few ideas.  Many of which have been said in one form or another in the last 65 pages I read today (I need a better life), so I do not claim credit for them all.  I dont know about you, but I feel much better.

Actually, and I am sorry to say it, I have been right all along.  Nothing to apologize for, therefore.  I also challenge you to show a post where I called Art, or anyone else, a "liar".

I understand you are hurting and feeling powerless as a result of how things worked out.  Lashing out at me and others who are pragmatic, and therefore less emotionally immersed, is also understandable.  If it makes you feel better about the situation and yourself, I have no objection.

This is the most depressing news thus far. I stanz all I can stanz and I can't stanz no more. I'd like to Popeye punch Sirius and Noory in the throat. From 7pm to 11pm, Sirius CH 104 will decrease your I.Q. I repeat, Sirius channel 104 will now decrease your I.Q. Listen at your own risk.

Goodbye Art...for now. God speed.

Just so you know I think every single one of your fans would have lived through the sxm "timeouts" and stuck with it as it truly is not a big issue to those who subscribe to sxm instead of having you leave all together.

Most non-competes aren't worth the paper they are printed on.  Sooooo, what I seem to be reading is that you will not just go on the air/internet and dare them to sue you under an invalid non-compete, so you can fight them off... but instead may challenge it up front to get it invalidated and THEN start up a show... am I in the right area?

If you think Noory enjoys his job, I want some of what you're smoking, STAT. If Noory enjoyed his job he'd, I don;t know, listen to callers, not have staple responses ("that's true" "that's true too" "that's very true") to anything and everything the guests says, he'd ask questions relevant to the conversation..OH! And he'd stay awake during the show! He doesn;t even enjoy the callers. He always sounds agitated. Noory enjoys his PAYCHECK and nothing else.

Keep something in mind.   Art is waging two battles right now and they stand in delicate balance  (I am in the middle of one myself right now so I understand).  You WANT the other party to agree/settle/backdown/whatever, so you can't go on a PUBLIC message board and make bold statements, because it simply puts the other party off.

Art wanted a deal where he was an independent broadcaster, etc.. you can't make that deal happen if you post about how bad the company is you are dealing with.

Art wanted out of the non-compete.. graciously.  You don't get that by going on a PUBLIC message board and posting "and if they don't let me out, I'm going on the air anyway and F em if they don't like it".

When you are involved in a public dispute, you MUST be careful about what you say and how you say it, because the other side is reading it.

If you look back about a week ago, or even a few days ago, you'd see most posters were expecting Art to live his entire life to suit our needs. The sense of entitlement expressed via vile and hostile bashing of Art, and anyone who defended him, was disgusting.

Can't refute that - enjoying his pay check, which is pretty significant.

I'd like to sleep on my job and get paid that too.

We can play the semantics game and no you didn't use the word "liar" but "raising the bullshit flag" and claiming that no attorney would comment on something, thereby suggesting that I was not an attorney is the same thing.

Art, I hope you DO fight the non compete and sue for the right to be on the air.  With a sympathetic or reasonable judge, they would consider your age and your career.  XM didn't operate in good faith and they tricked you into not ending things within 30 days.  PLEASE fight to go back on the air.  My BIL said we should all raise funds to help you fight this NC.
