I agree..I listened to every second.....He seemed a bit short and grumpy sometimes. But I still loved it.

Not nearly as grumpy and short tempered as his final years on Coast to Coast. I thought he sounded refreshed, energized on Dark Matter by comparison.

yes, because everybody on this board is a troll that sits in their mom´s basement and could not have gone to law-school. don´t be butt-hurt that art simply does not want to do the show anymore. perhaps his wife is complaining, perhaps its his back or perhaps he´s just too tired to do the show anymore. i dont buy the whole streaming excuse... quit after 6 weeks? camon... my bullshit radar is on.... really high at this point.  art needs to come out and tell everybody the REAL reason he quit.

History tells us that the only answer you will ever receive is that "things were at work behind the scenes" and that "someday, the whole story will come out." His dramatics here and everywhere he goes don't detract from what he does on air (very much). I enjoy listening to Art Bell do his radio show, when he does it, and I will continue to do so if he comes back to Sirius this week or if he podcasts two years from now. I get sick of the drama but what are you gonna' do? A lot of people still think he's fun to listen to, hence the anger when he doesn't do it. It's not likely he will accept one bit of blame for anything that's happened - He's a diva but still the best at what he does, when he does it.

Sirius should have, in good faith, disclosed the problems with their streaming to Art before they tried to sign him.

I really don't get why Sirius thinks it's a non-issue, or at least not worth fixing in a timely manner.

Not only can the NC be challenged, under these circumstances it would be unreasonable to enforce it and I doubt any court would enforce it. There may be issues of monetary recovery, but enforcement of a two year restraint of employment arising out of a mere 6 weeks of problematic employment with possible issues of breech is unreasonable and unlikely.

I'm not an attorney but in my experience, normally, a non-compete would mean that Art could not go out and compete with Sirius's Dark Matter show.  Sirius would not want Art to compete with himself by, for example, streaming the show he does for Sirius on his website and charging for it or streaming it for free without their permission. BUT he is not doing a show on Sirius, there is no DM show on Sirius to compete with.

So, I would think that Art might have leverage by invoking "reasonable expectations" and the normal use of a non-compete clause. I sold a business and signed a non-compete for 8 years. After 8 years I could have competed with the company I sold. It would seem to me that since there is no DM show, there is no need for a non-compete.

The down side is that legal matters and courts can be stressful and that might not be what Art wants at this time in his life.

Or after Noory's death, they'll just drag his dead body around and set him up at the mike letting the guests do all the talking and they'll slip in some George Noory single syllable words.  Voice in the beginning and end from recordings.  They love him there that much.  I may go back to listening then.

Interesting.  My experience after the 30 day trial without having given them any credit card and then never choosing a plan was that they somehow stole and used a new credit card account that I received two days before Halloween to charge me ON Halloween.  Today my credit card people are going after them with a fraud investigation.  I went ahead and used another email address and signed on for another 30 day trial without a credit card today to see what they pull in 6 weeks as capital one cancelled the account they stole and are expediting delivery of a new one.  So that's twice I
have signed up for a free trial.  They actually hacked somewhere into my Internet data and stole a credit card account to charge, with the first sign up. 

Art, do whatever you like, life is short but be happy and preferably do not go with Sirius.  It would be really nice to have people send you an email of the money Sirius got them for and have you reimburse them with dark matter items.  I wait patiently for your return finding many other things to do while I wait.  Thanks for contact!

It's not competition against Dark Matter that they're trying to protect against (which doesn't exist without Art Bell), the non-compete is for SiriusXM as a whole.

I called 5 times in 32 shows. One of those times was because Art was begging for people to call on Skype.

I called when he had open lines to ask a very pertinent question about the back catalogue and also to plant the seed of a 24/7 Art Bell channel.

My second call was the next night when he was begging people to call in over Skype.

The third call was the next night when he was also asking for Skype callers and I called to ask a question to Jim Sparks about whether he had any toilet breaks or was given food whilst on his 8 hour plus trips to the spaceships. A very important question.

My fourth call was during another open lines segment the night he ditched the boring guest. I asked him another very important question as to whether he planned on doing a Predictions Show on New Years. He asked me what my prediction was and I predicted the demise of the wrong program.

My last call was on Halloween to relay my story about my daughters "imaginary" friend. Art thought that the situation was very creepy.

All the correspondence I have had with Art and Paul have been positive so I don't believe I can be blamed for the downfall.

I know you are joking but the reason I was able to get on so easily is because 4 out of the 5 calls were from Skype. Because DM was not available to listeners overseas who never tried to sign up like I did there simply wasn't international audience to generate calls from over Skype. I have no doubt that if Art did a free online stream available to everyone then he would get many, many more calls from overseas.
