I am very confused about why Art is so willing, seemingly eager, to comply with the noncompete. Under these circumstances Art would be able to fight the noncompete and prevail, so why not try. Art should retain an entertainment lawyer ASAP to step in and negotiate a solution to this situation. There seem to be issues of breech and noncompliance by both parties. There are many legal issues to be raised that could, and should, lead to a successful conclusion for Art. That is, if he really wants to continue doing the show with an online stream. I am starting to question whether he really does.

Let's consider what a contract is about, it's an agreement the law will enforce. The contract defines what both parties will do to comply and when compliance fails it is called a breech. When one party fails to perform as promised and is in breech the contract will usually define what remedy exists for the injured party. But the clauses and the remedies have to be lawful and reasonable.

From what Art has described, that problems existed from the start, this contract seems compromised by performance and issues of breech by both parties. It is unreasonable to pick select clauses and say I won't comply with this but I will comply with that and still consider the contract as a whole. Under these circumstances it would be very unlikely that any court would enforce the noncompete agreement or interpret it to include a free internet stream from Art's web site.

It's not a matter of honesty or dishonesty relating to the noncompete, it's a matter of what is reasonable. My legal opinion is that enforcement under the described facts would not be reasonable. I think Art would be able to proceed with the show online.

The chess games is most likely Art's game--going thru these motions trying to make it look like Art wants to continue in order to placate his angered fans...when in fact Art just wants to quit.

The only reason this forum exists is because your program made a special connection with all and each of us...

We have waited 10 years for you...And after only 6 weeks you quit! And then you say -- state--- that you will comply with the NC clause?
And you really think, that we wont say much about it?
When those among us with legal experience say say NC clauses-- can-- be challenged?

The real problem, primary problem,  this forum has with you, is that you really arent keeping people informed...until the last few hours.

I agree with your central thesis: Sirius emphasises transmission to moving vehicles over  "table top"  reception. That in turn, handicaps listener involvement, which you find essential to a quality program. Further, their streaming player itself  is intrinsically buggy.

And to say -- theres lots going on which you dont know about-- Well , Art, you can tell us something, but you have chosen not to, havent you?
Why?  Dont you think after all this time, we deserve something of an explanation?

If you want the goodwill of this forum, just keep us informed. Its that simple.

But dont blame us.

Could be caus Art is a radio op. That is how it is for me. We get used to thinking of and memorizing different time zones pretty quickly. Which direction from here it is earlier, later etc. Where it is light out, where it is dark.

Art has ties to Cebu I think? Aeryn has family there?

Airyn's family is in the Manila area which barely even felt much wind according to some friends of mine there. God help Cebu though as they are still reeling from that earthquake just a few weeks ago. I lived in Cebu for a while and will always have a soft spot for that place. The saving grace was that the storm moved so quickly through that the flooding damage was minimized and the winds had already decreased after smashing through Leyte. Tacloban, east of Cebu, on the Leyte shore where the storm first reached at full intensity, is essentially gone.

That's the flaw in stockpiling foodstuffs. Hurricanes and Typhoons love to wipe that shit out too. Not to mention poverty makes planning ahead a bit difficult. I suppose if they all had an internet connection to ask for help it would have been a better outcome.

Trust me, I understand. I'm not arguing with you, I just personally wouldn't call it looting if my children were hungry, needed medicine, and clothes NOW. I'd call it doing what I had to do. The infrastructure in the PI isn't up to the same standards as we are used to here. Aid convoys are going to be pretty small and sparse and 200,000 people aren't going to quietly wait their turn.
