District Court Grants Securities and Exchange Commission's Motions for Default Judgment against a Nationally Known Psychic and his Corporate Entities in Multi-Million Dollar Offering Fraud

The Securities and Exchange Commission (Commission) announced today that on February 11, 2013 the U.S. District Court for the Southern District of New York entered default judgments against Sean David Morton (Morton), a nationally-recognized psychic who bills himself as "America's Prophet," his wife, relief defendant Melissa Morton, and corporate shell entities co-owned by the Mortons. In addition to ordering permanent injunctions from violating antifraud and registration statutes and rule, each defendant was ordered to disgorge, jointly and severally, $5,181,135.82, along with prejudgment interest of $1,171,110.54, and pay a penalty of $5,181,135.82 for a total of $11,533,382.18. Relief defendants Melissa Morton and the Prophecy Research Institute, the Mortons' nonprofit religious organization, were ordered to disgorge $468,281 plus prejudgment interest of $105,847.23, for a total of $574,128.23.

On March 4, 2010, the Commission filed a civil injunctive action in the United States District Court for the Southern District of New York charging Morton and his corporate shell entities for engaging in a multi-million offering fraud. According to the Commission's complaint, Morton fraudulently raised more than $5 million from more than 100 investors for his investment group, which he called the Delphi Associates Investment Group (Delphi Investment Group).

Beginning in or around the summer of 2006, the complaint alleged, Morton solicited individuals to invest in one of several companies he and Melissa Morton controlled under the umbrella of the Delphi Investment Group. According to the Commission's complaint, Morton used his monthly newsletter, his website, his appearances on a nationally syndicated radio show called Coast to Coast AM, and appearances at public events, to promote his alleged psychic expertise in predicting the securities markets, and to solicit investors for the Delphi Investment Group. During these solicitations, Morton made numerous materially false representations. For example, Morton falsely told potential investors that he has called all the highs and lows of the stock market, on their exact dates, over a fourteen year period. Morton further falsely asserted that the alleged profits in the accounts were audited and certified by PricewaterhouseCoopers LLP (PWC) who he claimed certified that the accounts had profited by 117%. Morton also falsely asserted that the investor funds would be used exclusively for foreign currency investments, and that any other use of the funds would be considered a criminal act. Morton further falsely claimed that he would use the pooled funds to trade in foreign currencies and distribute pro rata the trading profits among the investors. In private one-on-one correspondence with potential investors, Morton was even more aggressive in his solicitation. For example, Morton wrote to a potential investor urging he invest more money in the Delphi Investment Group "RIGHT NOW�[Because] [o]nce the DOLLAR starts to DROP, which will happen soon, we are set to make a FORTUNE!"

However, the complaint alleged, Morton lied to investors about his past successes, and about key aspects of the Delphi Investment Group, including the use of investor funds and the liquidity of the funds. According to the complaint, Morton did not have the successful track record picking stocks in which he claimed, and that he in fact was simply wrong in many of his securities predictions. Further, PWC never audited the Delphi Investment Group, let alone certify any profits. Also, unbeknownst to the investors, instead of investing all of the funds into foreign currency trading firms, the Mortons diverted some of the investor funds, including nearly half a million dollars to themselves through their own shell entities.

The defendants never properly answered the allegations in the complaint. Instead, the Mortons filed dozens of papers with the Court claiming, for instance, that the Commission is a private entity that has no jurisdiction over them, and that the staff attorneys working on the case do not exist.

On February 11, 2013, United States District Judge Forrest issued default judgments against all of the defendants and relief defendants. With the entry of the default judgments, the Commission received full relief requested in its complaint. The complaint charged each of the defendants with violations of Sections 5(a), 5(c) and 17(a) of the Securities Act of 1933, and Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 thereunder. The complaint further charged that the relief defendants were unjustly enriched by receiving investor funds. The complaint sought a final judgment permanently restraining and enjoining the defendants from future violations of the above provisions of the federal securities laws.

The SEC's litigation team was led by Bennett Ellenbogen, Alexander Vasilescu, Todd Brody, Elzbieta Wraga, and Roshonda Ledbetter. Amelia Cottrell, Stephen Johnson, Jacqueline Fine, and Elizabeth Baier assisted during the investigation.

If you go to the c.crane FAQ page for the transmitter, here:  http://www.ccrane.com/radios/fm-transmitters/fm-transmitter-2.aspx#prodDetails, then click on the first question, "How far will the FM transmitter 2 transmit?", it opens to a diagram and explanation for attaching a wire to the antenna.  It looks so easy peasy that even I could do it...but I never ever would.

Save your money, the CCrane unit only puts out a very tiny signal, somewhere in the micro watts. Australia allows non-licensed hobby transmitters up to 1/2 watt. I'm very impressed with the little rig I got from Amazon, you can switch it from 100 miliwatts to 500 milliwatts (1/2 watt)  I think around $54 includes shipping.

I bought that same transmitter and it rocks.
It's so powerful, I had to buy an attenuator so I don't get busted.
It covers my whole town without the attenuator.

As an aside, did anyone notice that apparently the only paranormal show on Sirius is Art's ?

Which struck me as strange given that there are a lot of paranormal sites out there and podcasts/videocasts.

I do wonder about the switch from AM to FM. I get bugged that except through my cell phone one can't listen to sports. I have to drag around a separate radio to listen to baseball or football when I'm walking or riding my bike because listening to online radio through Iheart eats away at your data plan something fierce.

On other thing. Locally C2C used to be carried locally on KSFO yet I would have to listen to it ( and Art ) via KFBK in Sacramento because KSFO used to fade and get a hell of a lot of static even though KSFO is in San Francisco. I have no idea where they transmit from.

I wonder if one has that problem with the FM stations that carried C2C or Art.

Except for news and financial programs, I don't listen much to AM radio except for baseball/football any more. I get the feeds off the net like when I listen to Pirates or Steelers games coming from the Pittsburgh stations. I am wondering what the feed is on Sirius for the NFL and MLB and if you have to pay more to listen to those or if its included in the price.

As someone who remembers ( a bit vaguely but I still remember all the talk about it ) the launching of Sputnik, I find getting radio from near space kind of fascinating.

I wonder if Sirius chooses its content or can anyone broadcast on their channel.

Podcasts from space ?

Or maybe one day from the moon or Mars.

I'm so looking forward to Monday when the Ghost Investigators Society is on the show. I know some people don't like them but they scare the shit out of me. I also admired their group is non-profit which gave them a legit vibe. I don't know what it is they're recording but listening to that in the dark is incredibly disturbing.

You can get a 15 watt transmitter for about $100 on ebay.  That will really blast a good solid signal around without tipping off any authorities, especially if you keep the antenna lower.    I think you get into problems when you're hitting the competing station's employees - if they hear your broadcast, they feel like they're losing money and *may* report you.   That's what stopped Art's pirate radio station.  Of course, he was broadcasting popular music and becoming well known.  According to the Art of Talk, it still took a long time before anyone put an end to it.    If you were just rebroadcasting Art's show, I highly doubt anyone would think anything of it - they'd probably just think it was a coast re-run coming in on some e-skip signal.

In regards to Sean David Morton...

I don't get the opportunity to listen live.  Would someone PLEASE call in and confront him about his fraud status?   I really wish someone had done so against "Dr." "Reed" I mean.. Jonathan Rutter.  I would love to hear what these quacks and liars would say when confronted by someone with some real knowledge of their pasts.

Never let 501c status give anyone a "legit" vibe, whether they are in it for the money or for some other motive.   If you know the people well and what they're doing, great, but many of these companies are in it for your money, and will use company funds to purchase things for themselves, if not give themselves huge inflated salaries.   Look up "criticism" under United Way on Wikipedia, as an example - and that's a huge corporation that one would think this sort of thing wouldn't go on under.

Some people who run non profits have ethics and what my Mother calls to be of good character.

Sadly many who run these tax exempt groups do not and use the money for their personal purposes.

So do bureaucrats who run state and Federal agencies like the head of the Post Office who remodeled his office to the tune of $ 800,000.

And the former head of Merrill Lynch who did much the same thing while the company and its employees were both going into distress.

I hope to make money doing things on line but unlike many, I wouldn't forget what it was/is like to be relatively poor and would give to charities, animal welfare and homeless groups that I KNOW aren't going to squander the funds.

Far too many people who have become rich don't remember when they had nothing & do little or nothing to help those who aren't so fortunate.

And that's unconscionable and selfish behavior in my mind.

One of the biggest new features of Apple's new iPhone 5S smartphone is its high-tech fingerprint sensor called Touch ID. But it looks like it can read more than just human skin.

TechCrunch tried out the sensor on a cat's paw and successfully unlocked the device. Just like with human fingerprints, the paw would have to be programmed to the iPhone 5S for access.

The Touch ID sensor reportedly works on other parts of the human skin, too, including the palm of the hand and forearm.

Several security concerns surround the fingerprint sensor, but we haven't seen any full hacks just yet. However, a group of hackers and security researchers have pledged to reward the first successful hacker with $13,000, more than $800 worth of Bitcoin, a pornographic book and a few bottles of wine, tequila, bourbon and whiskey.

A Wall Street Journal report last week revealed that if you leave your iPhone 5S untouched for 48 hours straight, you won’t be able to use the device’s fingerprint scanner to wake it up. Instead, you'll need to resort to the more traditional method of plugging in your passcode. The same goes for logging into your phone after a reboot.

he announced it on his revolution radio show as being scheduled for october 1st. (his birthday.) a couple of days later i called in to verify... he said he and art have a little ritual of him being on, on his birthday.
i am still having a hard time believing it though, not sure why.

Strange Universe Sean David Morton 2013 09 19

Okay, this is the conversation I had with Sean about him appearing on Arts show. Starting at 11:00 minutes. Got some slings and arrows in on GN and did a plug for the forum;)

Back in the 1970s I used to smoke pot but stopped when some made me so paranoid I stayed up for 3 days with a baseball bat in my hands because it made me think people were going to storm my apartment and kill me.

I think the caller from Weed California is classic. Either its a setup or coincidental but how do you take marijuana and not get stoned ?

SDM seems to be babbling a lot and I did love the brickbats thrown at Snoory.

I hope he does better on the air than this, this seems like a bad podcast episode in parts.

Note that SDM once again touts his accuracy record and yet there are sites that dispute his accuracy.

Has anyone ever gone back and seen just how accurate he was when he predicted things on Coast ?

He brought up undocumented aliens, a term I loathe, they're illegals.

Illegal aliens tend to not be insured by about 63%.

I know because my Cadillac got totalled by an illegal with NO license, NO insurance and I fought the case in the courts for 4 years because he had the cops arrest me because I left the scene because I had hit my head on the door frame, had a concussion and saw my glasses fly out the driver's window while his front bumper spun in front of my windshield.

The cops ticketed me yet did NOTHING to him, not a ticket nor did the DMV.

The pd involved said it was up to the discretion of the officer and when I asked to talk to him they told me he had left the employ of the department.

I finally got the case dismissed by a judge after it dragged into the courts for 4 years including my being taken to jail twice because I was too sick to go to court, even though the original judge in the case refused to accept several letters from my doctor saying I was ill and bedridden.

People forget here that Gray Davis, our former Governor, was recalled over wanting to give illegals driver's licenses.

Now the state has been completely taken over by Democrats and the crazed laws churn out of our legislature almost on a daily basis with no one questioning the legitimacy of the laws or applying common sense to them because there's no effective ability to oppose them.

This is what happens when you have one party government.

It gets worse as the California Air Resources Board is spreading its regulations to the other states, thereby putting after market exhaust manufacturers out of business. New York just bureaucratically adopted their rules as of July 1st forcing car owners to have the only choice to get their parts from dealers at high costs.

Unelected bureaucrats telling everyone else how to run their lives.

I know; I was thinking of opening a company making medical equipment used in operating theatres. The bastard bureaucrats effectively put a stop to that because I couldn't make the instruments sterile; What the hell are they talking about? It means now that hospitals have to go to established suppliers of theatre instruments and pay for all that R&D that goes into complying with construction and use regulations that assures a line of quality from concept through tooling and manufacture right up to reproduction of the same part for the life of it's intended longevity.
