Getting a lawyer might not be able to erase the non-compete but it's length could be shortened with shrewd negotiation. Just saying.

Aren't most non-completes super easy to knock down if payments don't continue?  Sure, Art isn't producing anything.  But that was by mutual agreement since they allowed for the extension of the 30 day walk-away.  So you would think they aren't continuing to pay Art.  So it would seem that any non compete would be super fragile.

But its the truth. Its not SiriusXM's fault..  You don't back out of a deal, then suggest an alternative one when you have already signed that dotted line. They were never going to entertain anything and the moment he backed out last monday, they were already done.

Yeah, luckily or unluckily for me I've stayed away from cell phones. Only a laptop and a lot of xm gear...lol. At least I didn't buy the shirts and mugs yet! I almost did!

I've taken you at your word on everything so far and I've been reluctant to join the chorus of those who say you were simply looking for an "out" because you decided that you really didn't want to be on the air anymore. You say you do and you would if you could. I still want to believe that.

So I have a hard time stomaching the idea that you *won't* fight to get out of your NC. I would think sheerly as a matter of principle, whether you go back on the air or not, you would owe it to yourself to regain your freedom, nevermind for the millions of listeners who have missed you on the air.

And given Premiere's evident hand in this and your past history with them, as you so agonizingly detailed on your first DM episode, I would think that would just add fuel to the fire.

I'm speaking on behalf of the many loyal and faithful listeners who have never doubted or turned on you. Please, please, PLEASE fight this. Assemble a legal team. Get out of the NC. Then decide whether you are going to go back on the air again or not. Don't let PremRat and Noory win this round, because if they do, I don't think there will ever be any way to challenge them or regain that lost ground again.

Just cancelled SXM. Surprising, they asked why, I said the cancellation of Dark Matter, and that was it. No attempt at getting me to keep the service at all. I guess their managers are saying "Don't argue with these people" or something.

Art, didn't you say you were going to try to find a way to do just that?  I remember an all caps "I WILL" that led me to believe something was in the works.  Your latest message is a mixed one... though I am glad you are ok & keeping us posted.

They didn't extend the 30-day opt out clause, they waived it so that once Art Bell left he wouldn't be in breach of contract. Unfortunately they're holding him to the non-compete but SiriusXM has been incredibly generous when they didn't need to be.

Looks like Jess & co. have new marching orders from the suits - here is what they are telling people on Twitter:

Same here. No discussion or attempt to keep me or to renew. Acted like they couldn't be bothered once they found out why.

Art had a walk-away clause that said he could end the show within the first 30 days if he chose.  But he did it outside of that, so he would have been in breach of his contract.  They waived whatever they did so that he wouldn't be in breach for failing to produce his show.

Which still begs the question are they paying him and if payments aren't continuing then non-competes get a whole lot more difficult to enforce especially after a little time passes because you are limiting someone's means to be gainfully employed.
