Art Bell Quits Dark Matter

I did a little research on Sirius after Art made his returning to broadcasting announcement.  I found that Sirius had some issues, especially with streaming.  Little things such as this, from 2009.

Oh, well, I thought I'll sign-up anyway since I wanted to hear Art.  I can always cancel if it's completely unworkable.  Silly me.  I never thought the host of Dark Matter would be the one cancelling supposedly because of such issues.  At least I didn't sign a 2 year non-radio listening clause.

Not only can the NC be challenged, under these circumstances it would be unreasonable to enforce it and I doubt any court would enforce it. There may be issues of monetary recovery, but enforcement of a two year restraint of employment arising out of a mere 6 weeks of problematic employment with possible issues of breech is unreasonable and unlikely.

It's just really sad to me that it seems our desire for listening to Art was greater than Art's desire to tolerate anomalies.

I have repeatedly told them when when ive called to pay my bill that they are NOT ALLOWED to automatically take money out of my account. In the end they turned around and did it anyway against my wishes and it wasnt just one month it was 6 months in advance. After a couple times of that my card expired and they were no longer able to get in. They forgot to turn my radio off tho so i enjoyed 1 year of free service Ha Ha

It is as though they expect him to publically state that he has no intention of honoring his contract.  What would the legal consequences be for doing something like that?

You should have read the rest of the post, I thought I was fairly straight foward in my explantion. 

To summerize:

1) I thought Art lacked the energy he once had.  I can relate, I'm not much younger than Art. 

2) Many, if not most, of his longtime guests were trying to sell the same old stories or were goofier than they were previously.  I was actually embarrassed for Tim Good.

3) With a few exceptions, his new guests were duds.  Even a talented interviewer like Art couldn't get anything out of that kid in Nevada or those two female ghost hunters.

4) His call volume was clearly down, a fact I attribute to fewer listeners due to his show being on a pay-for-service network as a opposed to free, over-the-air radio.  With an overall decrease in total calls, there was an apparent decrease in caller quality.  Art's frustration was obvious on this point during "Spooky Matter". Sirius may have 27 millions subscribers, but clearly most were not listening to him.

5) His topics, while still fascinating to many of us, have been done to death.  Even one of the food channels had a paranormal show.  Back in the day, Art was the Lone Ranger.  The wonder that was 90s are gone.

6) I think some (many?) of Art's fans outgrew the show, especially those now in their formative wage earning years.  Your priorities change from ages <25 to when your >40.  Mortgages, work responsibilities, braces for the kids, health insurance, etc. 

As I said some months ago, Art's early run at C2C was in a perfect storm....personal computers coming of age, the X-Files on TV, many of us (as was Art) tired of the political talk shows, and basically the rebirth of the interest of UFOs with surge in Roswell and Area 51 books/stories.

I am sure that is what Sirius will argue but as far as I know, Sirius has no show that could be said to compete with DM. If there is I would like to know what it is and see for myself whether it is a competitor of DM. What If Art wanted to do a radio show on basket weaving from his home? Would that be considered a breach of his non-compete? That would be pretty silly, IMO, to call that a breach of contract, again, IMO. That law suit would make Art Bell even more famous and popular, LOL.

I would also think that if the contract allowed him to walk away from the deal after 30 days, any reasonable court would consider that the NC can also be walked away from. Art may have to refund the $75K in that case which I am sure he would be willing to do.

Outside of that, maybe Art is right to think that there is something else going on. The outcome of all of this is that AB cannot do broadcasting for 2 years. Now we have to find out who would benefit from this. Let the conspiracies begin, LOL.

About every 100 posts someone says something positive.  The comments may be comical but I am also picking up some real hatred here.  It took me awhile to see it it but I definitely do.

I've gotten over the initial shock, and try to put myself in Art's shoes.  If we think the silence is deafaning... imagine what it's like in Art's studio right now.

You just said you've signed up for at least 2 free trials?

Look, you have to sign up with CC information. That's how "free" trials work.  In just about anything.  Most companies just automatically bill you if you don't actively opt out. 

This sucks, but it's not a "scam" by any means.  Next time, do some research into the product you're signing up for, and if you want to claim you're getting scammed, try not to admit you're doing the same.
