As I said yesterday. Heather Wade is fucking demented. It wouldn't surprise me if she, in her fevered delusion believes she's absorbed the soul of Art Bell into her. It would only take Lasha to tell her that (She's a psychic donchaknow) and she'll run with it for evermore. But like all cults, it won't end well. I very much doubt that Airyn, Asia and the newborn will be anywhere near the top ten of Ms Wade's concerns, and probably never were. Will the cult members be branded or tattooed with a sign on their foreheads?

Giving permission to use and giving free use has never been clarified. Something to keep in mind, I will use the Rush Limbaugh example...

Rush Limbaugh chose The Pretenders My City Was Gone as a way to attract attention and piss off holier than thou conservatives. Chrissie is quite the opposite from conservative... Well, years later, after he has paid tens of thousands of dollars into performance and publishing clearances to use the song, Chrissie Hynde decided to publicly state she was unhappy about that use.

Limbaugh pulled the song from his show somewhere between 2000 and 2005, I can't remember when. The effect on Chrissy Hynde's pocketbook was daunting. So much so that her publishing company even sent her a nastygram. In the end, she made an effort to say she didn't mind its use. My idol is a sell-out!

Getting back to Crystal Gayle, she obviously gave permission to Art to use it as the theme song.  In all actuality, Art could have gone and paid the fees and gotten the same results, it's just that he was being cool with somebody he liked very much (read into it "hair fetish").  Now, after the permission to use her recording of the song that she helped write, there are performance fees involved. We don't know if art was paying, through his music license, for the use of that recording as his theme.  There are actually rules about how much of a song can be used as bumper music before it turns into a full performance fee. I haven't gotten any checks from BMI or publishing houses in over 15 years, I forget how it worked... Maybe 15 seconds was the time limit for a bumper, I don't remember.

I hope the entertainment lawyers that Heather has hired has explained to her that, if she uses the song as her theme, she has to pay unless specifically granted a waiver by the responsible parties. That could even mean the record label.  In the current state of Music royalties, I don't see too many real companies waving fees.
