I'm Kind of Nervous to Post on Here Now

Last night I listened to the gabcast when George came on and it unnerved me somewhat. My understanding is that George is considered a public figure and thus free speech applies unless it is in a threatening manner or a false accusation of criminal intent. If there are any users who work in a legal setting or in a related field please chime in with your opinions. George if your reading this why do you care so much what people say on the internet? Seriously you probably earn a salary more than most users on this site and I find it hard to believe that you actually read this forum. I guess free speech isn't so free anymore?

It's always easy to go "get over it" or "ignore it" when your not the subject of it. He's not gonna sue, his people just talked tough as a ploy to get the anti george stuff to die down (back fired). He's got money but he still has feelings. He's also in a damned if you do, damned if you don't situation. He caused it so i don't feel sorry but i do understand his side of it.

What are you talking about? Did George threaten to sue Bellgab or something?

I have no idea what the legal standing is in the US; but in the UK (and as far as I know, most of Europe) the website owner stands as legally responsible for libel, threats on a person or property and threats of extortion, when posted on their site, as well as the person making them.

Ultimately they have to moderate it and delete any threatening posts in a reasonable time after posting. I'm on a site involving flying and it has a 'general' section that has had it's fair share of heated 'debate'; and the owner/admin has banned repeated offenders who have made threats or unsubstantiated defamatory comments. .

Defamation torts are much harder to prove here in the USA (for now, who knows when those secretive trade treaties are enacted) and different than the relative ease in the UK which are much friendlier for the plaintiff. Especially for public figures who also need to prove "actual malice." Also, truth of your claim is an absolute defense (however this could be difficult/expensive to prove and going to court in general can cost $$.) Keep in mind also that the laws and precedents vary by State. Some good links though:

Also, section 230 of the Communication Decency Act (1996) basically gives immunity to websites/hoster for statements made by third parties.

Big career change up the ladder, so I was pretty occupied with transitioning and learning new stuff.  I still love this place and it made the wait to Art's 2015 return seem a little faster to pass.
