"I started the show with the expectation that my listener's would be able to stream the show since most were coming from AM.

They started the thirty day trial and found that it was dropping out on them every few minutes. After the 30 day trial most did not renew, why would they? Faced with paying about $180 bucks a Year for something that was not working right, what would you do? So I lost my base.

My show is based on call in, if all I am left with is Truck drivers with cell phones going down the road at 70 MPH, well you get the idea. So I asked Sirius to allow free streaming for a Year until they could fix their problems and they said no. The show was simply not viable under these conditions. - Art"

That's all about the M.O.N.E.Y. ... the NC is punitive. It boils down to SiriusXM's contention that if Art won't make money for them doing his radio show, then Art won't make money with his radio show for anyone - including Art himself.

He signed the contract so he has to abide by it; or get sued. When it comes to contracts it's pretty cut and dry. There are two concepts that usually guides the lawsuit. One is known as liquidated damages, and the other is specific performance.

Liquidated damages allows the plaintiff's to recover any and all monies that they had to expend if the defendant doesn't live up to their bargain in the contract. Including salaries,leases, etc., owed or contracted for during the course of the contract. They have a right to be made "whole". This is also a reason why most entertainers take shows and syndicate when their contracts are up. Meaning that they take over all management and production rights that the company that they worked for ends. In other words they own and market their own show. Because of a lot of litigation, especially with the Simpson's crew if I'm not mistaken, there is some universal agreement in place that terminates the ownership rights of the picture houses and studios after 7 years. That's a lot of the reason why shows that make it to their seventh year usually goes off of the air. It is up to the crew to pick it up and keep it going.

Specific performance is pretty much what it says. You can be compelled to perform the duties in the contract or agreement  or be sued and have the courts impose sanctions against you until you perform according to your contract. Agreeing not to compete against those you terminated your contract and duties with is another form of sanctions that is applied.

I really don't believe it was. I believe that Art threatened to quit and Sirius XM said go ahead and quit. They apparently had C2C and a number of other cheaper shows waiting in the wings from Premiere. I really can't say that it was a mutually agreed upon separation based on the posts that Art has made subsequent to his departure from Sirius XM.

I chose Sirius XM for I think some very good reasons, they cover every inch of North America, well into Central America, Puerto Rico and so forth. They will let me do exactly what I want. Very few if any commercials, Basically Freedom, all the things I told you I would need to cut a deal.

First of all my sincere congrats to Premiere Radio, they made the right move. Business is War and I would have done the same exact thing, and did in my day.

Second, given the same circumstances I would make the same decision again today about Dark Matter. There is much you do not know and I will not talk about because it was given in confidence and I am kind of old school so I will not talk about those things even though it would help you to understand my decision.

Third, I would love it if Sirius/XM would waive my NC but they said no and even though I could run out and get a Lawyer and perhaps win back my freedom I will most likely not do that. If I were ten Years younger it might be a different story, I will say this, It seems crazy as hell to me that we offered exactly what Premiere ended up taking. Now Sirius/XM has a show that will be mostly commercials and seems much less a good fit than Dark Matter with a Host who thinks a Typhoon in Vietnam causes rain in Hawaii. (Last night's show, first hour)

Fourth and finally I would like to say sorry to the people who did come over either by Radio or the less than stellar streaming, trust me I understand your anger, I only wish you had enough information to understand my decision.

Seems like time for a UPDATE. As many of you know I left Sirius/XM after a short stint because we were having serious problems with the streaming service. They refused a offer to allow free streaming until it could be fixed. They promptly replaced Dark Matter with Coast to Coast AM on the same channel (104). I could speculate here about why that was done but I will not. I felt it was not reasonable to ask people to pay about $180.00 a Year to try and listen to a stream that so many complained was not working right.

At this point they have come and collected their studio gear and have left. I have asked to be released from my Non-Compete many times and they refuse, I have my own feelings about what has gone on behind the scenes and why at this point it matters to them, however it is what it is. So I will wait it out, then start a show that will air for free on the Internet. I have a time segment in mind which I will announce as we get closer to that time.

I am willing to give my all every time I crack the mike, but not for a show that has a built in limit on how large it can grow based on how good it is. So, that is where things stand today.

Otherwise the Bell Family is happy and well. My thanks to all of you that have followed this tortured path with me.

The Bell Family is well indeed! My new show will air from 9PM-1AM PT. If Sirius would free me from my non-compete it would have been 7-10 PT but while I understand both CC and Sirius did what they had to do, Karma is a Bitch. It will Stream for free and Podcasts will be available.
