I don't think this is a liberal/conservative issue. I am about as liberal as one can get, yet I think the police should be well equipped both with weapons and technology. Where I think most people draw the line the police becoming tactical in non tactical situations. There is little reason to serve a court order with the aid of a swat team.

Sorry about your misfortune.  What hurt more, the assault or the insult of having to wait to have your cry for assistance answered? 
I do hope that you were not seriously injured.  I'm assuming that because it took 2 hours for their response that you are reasonably intact. 

It's the old saying of 'When seconds count, the police are only minutes away.'  And that's an emergency.  After the event, one is just another call for service waiting in the responding units call history.  And check this, when calls for service are holding, waiting to be served, the cop can check his KDT/MDT display and picks and chooses which 'non-emergency' call to handle first.  A hit and run to property?  Naaah.  too boring.  Found stash of porn near a school?  Fuck yeah!  There might be some decent shit in that stash.  (Redacted) got assaulted?  Hmmm, not an emergency call, just a report.   Porn it is!  Wait, better call for back up.....there might be a lot of good shit.

Damn straight!  I remember the best advice I received in boot camp.  "You are the fucking weapon, everything else is just a tool for you to use."

There is no earthly authority that should be recognized that can tell you how or how much you are allowed to defend yourself.

Most of us just want to be left alone; to go about our business and our lives.  We generally wish no harm to others.  Yet when violence is visited upon us it is usually sudden and shocking.  Unless you have been trained, you stand a good chance of falling victim to the ambush or crime of opportunity.  Train up.  We were not born to be victims.

Times really have changed if I now have to train to be Batman so I can go out and buy kitty litter. 

From what I understand of the law, she has to hit me repeatedly before I can pepper spray her or I will end up in the can for assault.  I'm like most, just want to be left alone and go about my business.  I may just call a damn cab, ffs.

I agree.  You're effectively under house arrest because the cops won't/can't put a stop to this bullshit.  And that's a fucking disgrace.

In the time-honored tradition of "Psychiatrists go into psychiatry because they're crazy!" it has been my experience that the military and police (and other "helping professions," where power over people is granted, e.g., Nurse Ratched) attract many of the antisocial, psychopathic personality types. Usually, these individuals become dangerous to those around them, to the public at large, and to their co-workers. In many respects, it is not the weaponry as such that matters, but the thinking processes of those who wield the weapons. It is also difficult to rid your unit/workplace of these types of individuals, especially with the 'band of brothers, thin blue line, us vs. them, tough-guy glorification' -  à la baboon dominance-hierarchy mind-set. There is a legitimate question of how weaponized a police force should be, but there is also an ongoing, underlying issue of the 'culture' of policing.

This isn't to say that police must be social-workers (although, in essence, they often are), but that they need to be able to withstand anger and intense situations without becoming angry themselves. They need that most elusive of human traits: self-control. I have noticed an increased hostility, with an inability to judge reality, in my interactions with police over the last decade, concomitant with the increased militarization and a blurring of the role of police to include defense functions. The blurring of this line seems eagerly sought by the usual suspects, and thus, the profession becomes even more attractive to those of a functional psychopathic bent. It's a problem for which there is no easy answer.

There may be local differences in the law, but generally speaking there are two guidelines:

1) If there is a way to escape, you must take it (the only exception is when both parties are inside of your domicile).

2) You can act only if you have a reasonable fear of imminent death or great bodily injury from the other party.

Your "biggest fan" can hit you repeatedly and you still may not pepper spray her if that assault does not cause you reasonable fear of death or great bodily injury.  On the other hand, if she charges at you while brandishing a box cutter, you can pepper spray her before she even touches you.

Heh.  I'll cover the cab, but the tips and support of bellgabbers is priceless.  I am on house arrest, which does not seem fair... but who ever said this life is fair?  No one.  It sucks, but I have relative safety here.

This is why I am remaining indoors.  Each episode of contact/ harassment has escalated, and I expect a crude stabbing weapon may be next.  Yes, I've told her to stop, I've told her I don't want any trouble, that I am just walking to the store... you cannot reason with raging insanity.  Her answer to anything I say is, "I DON'T CARE!!!"  I picture me bleeding on the sidewalk while the cops take their sweet time to arrive.  By then, as usual, the crazy will have fled.

I will not risk being stabbed in order to defend myself on the way to the store.  I started stockpiling supplies two weeks ago, and continue to do so.  Until I get a vehicle, this is what I have to do.  Will keep saving until I can get one, and this will be over.

Now, she has screamed at me that she knows where I live, which I find unlikely.  This is a big complex, and she would be quickly noticed by security.  I have ample weapons here, and would love to see her even try that.  She'll be dragging her bloody stumps away.  Out in public, that's another story.

Maybe this is the wrong thread for this.  Maybe no one gives a shit, and that's cool too.  In any case, I realize I am on my own, and must rely on the one person I can count on.

The person as described is old and weak, she'll drop like a sack of potatoes.  All these homeless derelicts are weak and no match for a regular healthy person.

That and the police unions.

Even when reported and it goes thru the process and there is no doubt from anyone they are a bad cop, the union steps in and prevents them from being fired.  They get maybe a short suspension or a few months of desk time, and they are soon right back at it, even more emboldened.  If it's really bad, it may be 6 months or until everyone forgets before they are let back out in the communities.

Your palm method was explained to me by my father, he swore by it.  I've used it once before, years ago, and it worked... resulted in lots of blood though. 

Here's the thing, I don't want to go to jail by our militarized police for assault.  If she took another swing at me, could I legally use this method as self defense?

Well, I'd pick the time and location - no cameras or witnesses.  Don't hang around.  If the cops come, lie if need be - either deny it completely or tell them she said she was going to kill you and then came toward you.

I can't really envision 1) the cops coming, 2) they decide to arrest you, 3) the DA decides to prosecute, 4) a jury convicts. 

People get punched all the time and nothing happens.  Look how the cops react to her. 


By the way, assault is what she's doing - threatening you.  Battery is the physical attack.

And cities who pay out huge settlements to victims (or the vics families if dead) of beatings and shootings but don't charge or deal with the cops, or change management, of the police. I live near a very (VERY) "liberal" area of FEMA Region VI and although the City Council does things like spend $$$ for a new library (basically for the homeless since children and even adults mainly do ebooks or Amazon and wouldn't go there due to homeless and parking problems), a $$ walking bridge across the river because one with cars too dangerious, currently debating to remove gender from bathroom doors (surprise those womyn when they go in and there is a urinal?), voted to become a sanctuary city to support illegals, and ill-fated and $$$ stuff as light-rail system that nobody uses and goes nowhere anyone wants to go-- they continue to have police that shoot people (usually blacks) and they pay out. In one recent case a cop shot an unarmed guy in the back of the head after a foot chase. I think that guy, finally, got indicted, after months of hand-wringing but usually the city just pays out, settles, etc. Police chief not changed. Practices unchanged.

I'm not lawyer and I don't know your state or local pd but even verbal stuff is technically "assault". If she hits (or even spits at) that is battery. But even assault is a crime. (Some jurisdictions called personal threats "terroristic threats.") All of which should be reported (even if you have to go to the police station.) Try to film some of her threats and actions. Even maybe a restraining order? At least then you have paperwork if you need to defend yourself and proof to police that the threat was already identified.

In a battery certainly you have a right to defend yourself, maybe even an assault if you "feel threatened and harm could come to you." Although police are militaristic etc these days the homeless are even on a lower-ladder than you. They call us "citizens" but homeless, derelicts, drug-dealers, hookers, etc they don't care at all, they supposedly sometimes call deaths, crimes, etc involved with those people NHI (no humans involved.) I wouldn't worry too much if you had to take action against this homeless lady. The police won't likely care much about what happens to her unless you are causing them paperwork etc. Obviously I'm not encouraging any crime or pro-active, possibly, illegal measures but only legal measures (like documenting, reporting to the PD, restraining orders, and defending onesself when attacked.)
ps: (again unofficially) I've been told that the Wasp spray is effective as mace/pepper from some people. It shoots 20+ ft (in any confrontation the closer, the worse) and is sticky and blinds perps. Certain brands better than others but substantially cheaper than mace/pepper defense sprays. (again unsure if true but I've heard it several times and definitely cheaper. Guy at gun store said he recommended it to his wife. IDK.) Looked it up and, apparently, it would be possible that you violate the law by using Wasp spray for a purpose for which it is unintended. And possible to be charged with poisoning a person. So go with CC, mace, pepper spray, or taser- if civil means fail, I guess.

If you don't want a lot of blood use the palm method under the chin. Hit em hard. Snaps their head and body backwards. In one swift motion, use enough follow through to push their head and body backwards. They will land on their ass, dazed and confused how they ended up on their ass. It won't bruise your palm or her chin. Getting your jaw jacked like that will cause pain in the jaw joints, nothing life or death. Although it may break her meth addled teeth, neck, or crack the back of her skull if she is laid out flat. Such confrontation could end up harming one or both persons. Maybe even taking of a life. Bad things can happen in a brawl. I've used palm under chin to take down a guy who was a head taller and weighed more than me.

When there is no way around getting physical with someone, getting booked for assault and battery is better than getting booked into the hospital. I can understand your aversion to being charged, possibly getting a criminal record. You have plans for your future, and wisely don't want some bullshit record that will mess that up. You possibly have much to lose over some crazy meth head confrontation, she has little to lose. Her whole world is just living for her next aspiration of meth. Whereas your aspirations in life are much larger. Any contact she has with you could be a gain for her in some nefarious way. You have zero to gain coming into contact with her. No matter the outcome.

I've read your post here and listened to you on a few podcast. You are a bright person and I know you can outsmart some crazy homeless meth head. Don't let her scare, or bully you. You are better than that, and you know it.

Back in the day, I arrested a number of ppl for making threats.  Terrorist or Terroristic threats.  Here in the PRC, that is a felony.  The cop doesn't have to be present or have the threat made in his presence to effect an arrest.
A misdemeanor requires that it be done in the officers presence or field of vision for an arrest to be made.
It could be that she screams 'I don't care about your kitty and its litter.  I'm going to beat you to death.'  Or something along those lines.  Be sure to articulate your extreme fear of injury or death at the hands of this wack job.

Funny how the more you dig the more you find. What I do not understand is how people still think that it is ok? It blows my mind when i talk to people and they are tell me they are just doing their job. You should really look into Philadelphia and look up house seizures. You will be shocked. But hay keep supporting your local police department because they are their to help you!!1
