I hope MV will consider having a Gabcast on this...I feel sure Leo Ashcraft would have a lot to contribute to that conversation, as well as Bateman, and SaucyRossy.

whos knows if MV would want to get involved lol

Leo was kind of the beginning of the latest ending.  No slight meant to jazmunda's contribution.

I honestly just feel sad about Art Bell now. I wish him well in his lawsuit and for his family. The guy makes really strange moves but now that we're not all caught up in a bait and switch, I don't really care anymore.

Like I said, I'm not emotionally invested in this one. Maybe. Maybe not. We might never know if it's settled.

What if someone in your hometown publicly stated in a public forum of some sort that about you and your wife? No big deal?  ???

If MV could connect enough phone lines, I'd add jaz, Chefist, Heather and Keith as well, for sure.   :)

Savage is protected as an entertainer. I don't remember the exact wording but if you could actually sue for this sort of thing virtually all of the clickbait media and comedians would be out of business over night.

So, you know that the power ultimately resides with the queen of England then.

Someone interviewing Keith is BellGab's white whale now.

In that few seconds radio clip, in which Art's or his wife's name was never mentioned, where was the "actual malice?" And would any of us at BG, or especially in the general community, even know about it if Art didn't broadcast on FB etc? If actual concerns about his, or his wife's, reputation or future earning potential (or mental issues, which the Hustler decision did away with for good or bad) was at question why publicize it? Who even really heard that few seconds clip on a show with not that many listeners (compared to the population?) This coming from an admitted huge Art fan and who listens, and re-listens, to old shows but suspect of his choices legally and professional sometimes.

Keith, as I recall, was involved (at least in court fillings) with the Ted Gunderson/WWCR/etc Art lawsuit stuff. Forget the details on it.

I suppose he could make the case that it was a failed attempt at comedy. It seemed specific enough and mean spirited enough to me to be taken as an attempt to damage Art's reputation, not that he hasn't done a lot of that on his own, as we all know.

Yes, but she doesn't exercise it. The day she does in any meaningful fashion is the day Australia becomes a republic.

It's controversial precisely because of the queen's representative actively interfering.

Call me a troublemaker if you like, but I want to hear it all.  :-[

I even saved the link Art posted on his facebook, just for my scrapbook you know...

http://www.allaccess.com/net-news/archive/story/160340/art-and-airyn-bell-sue-michael-savage-for-defamati

Leo commented on his facebook page as well, but since he's not a bellgabber, and able to defend himself here,  I won't share that here.

(sorry for having gone off thread topic here, I'll behave myself now).

As far as defamation goes, it would be clear cut, because Micheal "Savage" Weiner's claim isn't true, and it's an attack on reputation. I think the suit is justified too. But like it's been said, it's likely impossible to prove in a court that Weiner was referring to Art.

You're getting hung up on the name but we all knew just from listening to it who he meant. The potential damage would be if a potential employer or sponsor actually took it seriously and thought he was a pedophile creep.

It happened in Canada a couple years ago when one party didn't want to go along with the globalist agenda. It could happen there too.  ;)

That wouldn't matter. We're talking about damaging his reputation. One doesn't have a reputation with people who don't know about them.  ;)

Art is a public figure (even more so with his broadcasting of his outrage over Weiner's claims,) where was the "actual malice" in Weiner's few seconds aside, or joke, in which he also never mentioned Art or his wife's name. (Art's wife might successfully be held to a lower standard since she is not public- though even there Art has talked/posted so much about her Weiner's lawyers could argue that she is a public figure also at this point, maybe?) And would anyone reasonable believe the claim? That is the standard now after the Hustler/Fawell decision where even worse stuff was alleged and by NAME (not sure what the California, I assume where filed, law is but that should override.) Only playing a lawyer on BG. This from an Art fan who still re-listens to old stuff but think he is getting a bit bizarre and over-reactive to minor events.

I disagree with your perspective but maybe something could be made about that last line "That's an inside joke for radio people" or whatever Weiner said. Also seems like a shot since Art fucked over Cumulus. I still think this is fish in a barrel for any defense attorney if this even goes to court.

I can't stand Weiner though, so I do hope Art takes him to the cleaners.

Art should sue himself if hes worried about his rep being damaged.

The biggest crux of a defamation case is a provable loss of income as a result from the supposed defamation, in my experience. I'm confused how Art proves this impacted him on any level and especially financially.
