First off those numbers are a joke.

It's far more likely he started off with a hundred thousand or more listeners with most of them being his base.

The millions of listeners you talk about listen in their car for the most part and not many people other than truckers are driving at that time of night.

So for Art's show to truly grow in numbers it had to rely on people listening through streaming. And with many of Art's fans not being technically knowledgable (look at the lady who runs the people who love art bell Facebook page, she was freaking the fuck out about Sirius constantly), having the stream drop constantly is a disaster. Even the whole keep listening thing was a horrible idea, Sirius is the only radio that assumes you're not listening. Can you imagine how frustrating those issues would be to a demographic of people who have a hard time logging onto Facebook? Holy shit it must of been a disaster. I can't even imagine the emails art got about it.

So no, millions of people were not and even over time probably wouldn't of listened to dm. It's clear now that Art was doing what he could to have standards and Sirius doesn't care about high standards.

You're probably right that it's the same demographic.  Which makes catering to them even sillier.

Having to move your cursor every 4 hours is not a deal-breaker for most people.

Sirius and Art are still talking, folks.  Don't give up, don't give up!  He will be back.

Yeah, thanks for the dose of hope.  After all, Art hasn't received his "no" yet.

(well, not in any form besides his frankenstein monster replacing him on his timeslot)

Remember all the squawking that Sirius would NEVER let Art stream for free and have a presence on 104?

Don't hear too much from those folks now.

They're also not promoting C2C as exclusive to their network.

How was it a set-up?

Sirius XM removed the entire Talk Radio channel which is where Coast aired.

I fail to see how that's relevant, they do channel switch-ups all the time. Hell, there are about 30+ talk channels at any one time.

Mr. Noory, thank  you for your service! Just not  on 104, that is Art's channel.  He started the channel and you follow him.  It's nice to be second best isn't it?

You are good at playing Follow The Leader.

lol Art did not start that channel

and c2c was broadcasted on SXM before DM

but let's not let facts stand in the way of our 2 min hate session

As far as I'm concerned--although I personally took all of his explanations at face value and never doubted for a minute that he was being on the level with us the whole time, or at least as on the level as he could be under the circumstances--I hope that everyone else will consider him vindicated across the board. So now perhaps those who've pointed fingers of blame and accusation at Art from the minute this situation began will likewise have the stones to apologize.

Nope.  Not at this point.

If I knew my competitor was on the way out, I'd sure as hell move to replace him and get back on the broadcaster that dumped me for him.

Think back. This is why Coast left SiriusXM in September. They knew Art did a deal with SiriusXM.
Jocko Johson's comment is wrong. While most Clear Channel stuff is gone from Sirius XM, Z100 & KIIS are still there.  I listened today. Channels 11&12.

How do we know Art's agreement with SXM wasn't contingent on them removing C2C and other paranormal shows (like Ground Zero, I believe) in order for him to become their flagship program in that area?

And if that IS the case, and their agreement is no longer in force, why shouldn't SXM be able to go back to their old programming?

Alright, many of you have stated that you are lawyers.

Do we as listeners have a case against Sirius for not providing the content we paid for?

Or are any of you able or willing to help Art if he needs it and requests it?

Art doesn't want to be off the air, this non compete is bullshit, time to get this fixed.

i'm pretty sure that buried deep somewhere in the fine print is something about how sxm reserves the right to program whatever they wish

as for c2c replacing art

But if Premier was behind any shity play to bring Dark Matter to an end something should be done. Its called espionage...to purposefully rig someones livelihood to fail. Yes, I am serious. Sirius failed to deliver the show in a manner that perpetuated listeners. They breached the reasonable expectations of the show. When confronted with their obvious shortcomings and failure to deliver,  they bailed, they left AB hanging and the listeners hanging.

IMO and in my experience, Sirius could sue AB if he went ahead and did his show. In order to get monetary compensation or to cause AB to cease and desist, Sirius would have to show damages. They have no show that competes with DM, hence no damages and no cease and desist. They brought upon themselves their own damages. I, like a lot of others, cancelled Sirius.

That's impossible to say without seeing their contract.  However, Art Bell has already stated on this thread that he didn't believe SXM is in breach.

Looks like I ruffeled some feathers...I was actually harassed by what I think was someone from Premier over at Dark Matter Forums...waduya think???

I posted...

I was just on You Tube as usual looking for a good recent C2C show to listen to. Guess what. I couldn't find one recent show....as a matter a fact I was hard pressed to find one entire show. Two weeks ago I could look up any C2C a day ot two after and it was there. I was able to google some but when I clicked on the link is says removed!!!! But when I type in Dark Matter every damn one of Arts shows are there in there entirety....many titled C2C Alternitive. Im pissed. Go ahead...look. I challenge anyone to find me the C2C show from Sun Nov 3rd. and post the link. Bet ya cant....but Dark Matter.....you bet. I'm disgusted.

Then someone called premierecleanerabx signed in as a guest and said.........John,
You need to stop. Your threads have been followed across the world wide web and have now come to our attention. We handle our matters, and property internally. You know full well what this is in reference too. This matter does not involve you. There is nothing sinister and Dark going on here this Matter is not of your concern. There are a lot of good radio alternatives C2C am for one. They archive their shows just as you like. How are things in New York? How about them Knicks? You need to relax get some rest maybe get away for a while.

I answered with...It is my concern. Arts show could have just as easily been removed from You tube. I think Art is being treated unfairly....I think the whole thing was a way to get him into another couple of years of No Compete. Or at least tarnish his legacy. I can think what I want..its America isn't it....at least for the time being. Struck a cord huh? Your post makes me think Im right even more..maybe the facts are a bit shuffeled but premier has it out for Art. Coast to Coast is their night time Baby and they cant have Art coming along and screwing things up. Their...you...whatever are all for conspiricies till they involve them....you. (Noticed premire in your name and you recomend C2C) I listen to robot George only when the guest is good. Art himself is almost always as good as any guest and you know it. And who the f(*& is John??????

Are you kidding? Do you know how easy it is find C2C eps on youtube? Do you know how many hundreds of channels there are on it that have the sole purpose of posting C2C shows, without commercials?

CALL FROM SIRIUS

Did subscriber get a call from Sirius like I did this morning at 11:30 a.m. EST?

As I was showering, I got a call from an unlisted number.  As I just broke up with my GF, and was expecting a call, I picked it up, only to have Barb of Sirius on the line.  Not a flunkie  from India, but very well educated and knowledgeable.  Barb asked me if I was a subscriber to Dark Matters, and did I still desire to quit Sirius if Art Bell was no longer on the air with them. [As an aside, I wrote passionate letters to everyone and anyone at Sirius, including by email and regular mail, asking that they keep Art on the air and work with him.  At no point in my letters did I take Sirius to task in any way, other than I wanted Art on the air.]

I told Barb that while I understood Sirius' position over Art's position, I had subscribed only for Art Bell, and without him I wanted to discontinue.  Barb said Art Bell is not on Sirius.  I asked could he return and she said he will "never" be on Sirius.  I replied "never?"  Barb responded "ever."  When I asked her how she knew that, Barb said her "superior" told her that, and when I asked who that was she simply repeated "my superior."  I said I would indeed like to discontinue Sirius (I signed up for a year, and got a free car radio in the process), and Barb proceeded to indicate my subscription would run till Nov. 13th, and I would not be charged beyond that date.  [I found out later there was also a termination fee of $75, which Barb failed to mention during the call.]

During this process I asked Barb why they were doing this and she said in response to my letterS, emphasizing the plurality of letters.  Has anyone else gotten a call FROM Sirius, volunatrily ending the subscription?  The $75 fee has tempered how I feel about it, as that is roughly half a year at the monthly rate I subscribed for, and I thought it very unusual. I am an attorney by trade, and have dealt with an inordinate number of corproate types, and this woman seemed to be well-above the bottom rung of the ladder.

Anyone else receive a similar call?  My last name begins with "A" so I may be first on the list, but I may also have gotten this largely because of the over-the-top efforts I made to be passionate and yet reasonable about this whole mess to Sirius.

that's so ominous  :o

so uh, how do you think sirius hacked your info? do they spy satellites, too?

I don't even listen to Sirius.  Asshole.

You just said you've signed up for at least 2 free trials?

Look, you have to sign up with CC information. That's how "free" trials work.  In just about anything.  Most companies just automatically bill you if you don't actively opt out.

This sucks, but it's not a "scam" by any means.  Next time, do some research into the product you're signing up for, and if you want to claim you're getting scammed, try not to admit you're doing the same.

Wait. So, somehow Sirius "hacked" (your words) your financial information from God knows where -- not once, but twice. It was apparently bad enough that you complained about it here several times in this thread alone. And then you signed up for a third free trial?

Were you, like, expecting Saint Francis of Assissi to miraculously come blasting through your radio this time or something?

Well, everyone knows that when you a company "scams" you, you just keep going back into it.   ::)

Interesting.  My experience after the 30 day trial without having given them any credit card and then never choosing a plan was that they somehow stole and used a new credit card account that I received two days before Halloween to charge me ON Halloween.  Today my credit card people are going after them with a fraud investigation.  I went ahead and used another email address and signed on for another 30 day trial without a credit card today to see what they pull in 6 weeks as capital one cancelled the account they stole and are expediting delivery of a new one.  So that's twice I
have signed up for a free trial.  They actually hacked somewhere into my Internet data and stole a credit card account to charge, with the first sign up.

So you're scamming them while they're scamming you? Excellent.

Id be thankfull and wouldn't hire that landscaper. They brought on themselves by not working with Art when he was given the wrong set of tools for the kind of show he does, nothing more.  Its is them Ignoring him that is perpetuating all this. If the answer is no is it so hard to call and say, NO. I myself never had a problem but there has to be some reason the floor fell out after 30 days. Art went about it a bit dramatic which was wrong but that's just Art. He is a very passionate person. If your legacy was at steak wouldn't you? I say all this respectfuly to you and Art. Lets just hope they let him off the NC. Then we will all know for sure what's what. If I was serius/xm Id let him off only if he shut up about them.

if my legacy was at steak, i'd make the best damn steak in town

i'd bring in all the landscapers to eat at my steakhouse

they could even call and shoot the shit with me on the cellphones

I don't get those who don't get Art honoring the NC.  Isn't that a legal agreement?  If he just popped up elsewhere and began a new show, wouldn't he get sued?   I'd guess if there's a legal way out of it he's pursuing that option.

They let him out of the employment contract, why not the NC? Why not at least try?  Couldn't hurt to ask.

Or... you know, lawyer up.
