What is this non-compete clause?

Once a week, maybe twice, is what I strongly recommended the last time he came back. I knew he`d never make a full-time gig work. And he sure as hell can`t make it work this time -- if there is a "this time", which I tend to doubt.

With regard to Knapp; he`s not going anywhere. He loves it where he`s at, and has publicly stated as much on several occasions.

I was surprised, too, when Art was trying to do so many nights for Dark Matter.  It seemed akin to his eyes being too big for his stomach.  I still can't help but wonder if the work load of DM got to be more than what he was looking for.  The uneasy feeling of "here we go again" started creeping in when he started bailing out of the DM shows.

I'd be thrilled if he just came back for several nights a week.  A weekend show would seem to be perfect for him at this point. I'd rather have a little of Art than nothing at all, in the non-gay sense.  Not that there's anything wrong with that.

Nope.  Not here.  But no doubt Tommy's getting excited.  I think Art is way, way out of his league, though. He'll just have to "love the one" he's with.

I think you have all been led down the proverbial garden path. The streaming issue is not a credible reason for Bell leaving Sirius. As is always the case this is about money. Bell felt certain  that he could deliver a larger audience than what materialized. In addition I am sure that his audience began dropping off after the initial thrill and disappointment of his return. As the free 30 day promotional trial of Sirius was ending many cancelled out not feeling ole Artie was worth the 10 bucks a month. I know I did. It isn't just the evil Sirius Corp., but your hero Artie Bell decided that they could not generate the dollars to make it all worth while.

So you are saying that Bell was/is guilty of the sin of the protégé (yes thank you autospank!) as in well, the argument about Bell vs Noory should be evident...

I think it is interesting, in fact I recommend that you listen/watch this song/video over and over until it becomes clear.  Art never pooped on my curb, well maybe figuratively one time, but Noory does it daily (after all he is broad cast, and them broads...) and Noory doesn't even have the decency to turn it into a finely trimmed bush....  Oh yeah the song, it is supposed to carry you over to the end of the non-compete,  it works for some people I think (myself included...)

I am not in the broadcast industry anymore and when I was, I wasn't valuable enough to have a non-compete clause signed. Today I am in the tech / e-com world and I did have to sign one a while back. 12mo is pretty standard however I highly doubt it would be enforced.

I will say though:

1. Non-competes in the business world are very hard to enforce. Most companies use them as a scare tactic and usually do not commit legal / $$$ resources to a breach. Very dependant upon the who and where of the situation.

2. Depending upon your state laws, it may be illegal to apply or even ask an employee to sign.

Case-in-point: I worked at a company for a short time where all salespeople had to sign a non-compete. The owner sold the company. 6mo later he poached three sales people. The original company started the formal legal process, but didn't follow through. At the end of the day, it wasn't worth the trouble.

Now a fairly well known media personality like Art Bell is an entirely different case. SiriusXM has very deep pockets. Art is a known commodity. There are more outlets for media today than ever before. My opinion, Art sitting out for a year was the correct choice. SXM has deep pockets and were likely to come after him. If Art were fired from SXM, then a non-compete would likely be null / void unless SXM was willing to pay his salary for the term of the non-compete. Art must have formally quit, which in hindsight was a horrible decision. The best course of action is to man-up, and follow through with your agreement. If you are disillusioned, go to the decision-maker and plead your case, but do not quit.
