Tinfoil hat talker Art Bell sues radio rival Michael Savage

The witness list for this trial should be out of this world.

Art Bell, radio’s famed cult, conspiracy and UFO enthusistist is suing conservative talk show host Michael Savage for defamation and invasion of privacy, according to a complaint filed in U.S. District Court in the Northern District of California, reports the radio industry trade magazine, Talkers.

Bell, 71, is livid over comments Savage made on his syndicated radio show in September that seemed to alluded to Bell’s own radio show and his wife, Philippines national Airyn Ruiz Bell who is believed to be more than 40 years younger than Bell.

On the "Savage Nation" broadcast Savage said: "I generally avoid gun questions. I know this from the first day in radio. I learned you never do certain topics where you can destroy your show. Third rail… You say UFOs, you wind up in the Philippines with a 10-year-old hooker and you are off the radio after a number of years. You can't do UFOs. That's an in joke, by the way, for people who understand the business. There are other topics you can't do…"

Bell met Ruiz via email in 2006 and traveled to the Philippines, where she lived, to marry her â€" just a few weeks after the death of his third wife, Ramona.

He has also taken many breaks during his career, disappearing from the airwaves under mysterious circumstances and returning years later.

In the suit, they are seeking undelared damages from Savage, Westwood One and parent company Cumulus Media for defamation, invasion of privacy, intentional infliction of emotional distress.

Cumulus is sure to carry Goblins 'n' Such with Art Bell now.

Ironic that Art himself brought more attention to the comments than when Savage originally said them. Perhaps Art could sue himself.

Is this the kind of lawsuit where the loser has to pay the other guy's legal fees?

PremRad, SiriusXM, Cumulus, talk about burning bridges.  Mr. Bell could learn a lot from this guy.

I totally get why Art is pissed about those comments, they are horriblly insulting to his wife and the mother of his children but it was a quick comment on a daily radio show. I'm sure most people had no idea what Savage was referring to and those that did probably forgot. The moment Art announced his marriage to Airyn people have made "child bride", "gold digger", and "green card seeker" comments about her so this basically is a retread of that so the people in the know had heard it before.  Now by filing a lawsuit it's in the New York Times in B/W print forever... he should have just dropped it. Enjoy your life Art, you have a lovely wife, a beautiful precious daughter, and a new baby on the way, no idea of your financial situation but I'm sure you're in a better spot than most 71 year olds.

This Saturday on Somewhere In Time With Art Bell:

>6-10pm PT: Art Bell - Somewhere in Time returns to 6/3/97 for an Open Lines search for a practicing witch. Who called in was the legendary (and late) Evelyn Paglini who became the show's witchcraft expert for many years.

Cool! I'll set a reminder to listen! I always enjoyed her interviews.

He's loaded.

And bored.

A detrimental combination toward good judgment.

I remember Art saying something about being "thick skinned"?

I'm just not seeing it.

Art should spend his final years by going on safari looking for lost cities via the underground tunnels of Tibet that lead to the Masonic blue inner-Earthers.

A much better use of his time that comes with superior souvenirs.

Art and Mike are not rivals because art is not on the radio and Mike is not a quitter like art.

akwilly

Art just kinda sounds like a bitter old guy now. Hell Savage didn't mention him by name and I'm sure no one would have given his statements any more thought if Art would have just let it slide.

albrecht

I haven't caught Savage in a while because he is on a relatively low-station here now and obviously haven't heard Art in a while due to the quittings but weren't they both a proponent of Trump? I also recall stories of Weiner's tropical travels collecting plants and skinny-dipping with Allen Ginsberg or some such hippie, or even homo, weirdness so find it odd to cast stones. Especially to a guy who has some COPD disease and quits all the time and is not even on the air. (His old shows tho are still great to listen too.) AND who has a history of sueing people who insult or make perverted insinuations or charges. And has won.

Ha!  Yes, I'd think you'd actually have to be on the radio to be a radio rival.  :))

"At present, Mr. BELL is strongly considering resumption of his radio broadcasting and journalism careers," the complaint adds. "However, the Statement has harmed his professional reputation and is hindering his efforts to return to broadcasting and journalism." - See more at: http://www.allaccess.com/net-news/archive/story/160340/art-and-airyn-bell-sue-michael-savage-for-defamati#sthash.1VH304CT.dpuf

Pretty cheeky for someone with a worsening COPD condition.

A cynic might suggest that damages would be based on lost income, and a retired radio personality wouldn't really have any lost income to recover. Enter suddenly pre-undisclosed ''efforts to return to broadcasting'', which are being ''hindered''?

It's really time for Art to fuck off.

... The suit then covers the legal ground for defamation â€" “reckless disregard for the truth” and “cognition that such broadcast would defame and disparage plaintiffs.”...

Is that the standard for a public figure?  Whether he fucks off or not, this is looking weaker and weaker.

Art Bell and his wife sue Michael Savage and Westwood One for defamation.

Bell says Westwood should’ve hit the dump button on his September 25 show, when Savage allegedly said this â€" “You say ‘UFOs’ [on a radio show], you wind up in the Philippines with a ten-year-old hooker and you are off the radio after a number of years...

... The suit says she “has never been a prostitute.”...

Art is probably angry that someone else is savaging his legacy.  He wanted to do that all by himself.  At least he has a thick skin.

I don't know but in most places I thought you had to prove "actual malice" if you are a "public figure," in addition to the others to make a sucessful defamation claim. It would seem his lawyers are holding contrary opinions:
1) he is not a public figure so doesn't have to prove "actual malice" (especially since he wasn't EVEN mentioned by name)
but
2) he is being damaged because Art wants to become a public figure later ("considering returning" etc.)
Art is reminding me more and more of an old landlord lady/neighbor I had in school. Old rich lady who never left her house and smoked long-cigarettes and would summon her attorney or accountant to rant, threaten to sue people, or change her will if a family member slighted her.

Rix Gins

I remember a number of years back hearing Savage say that he never wanted to broadcast late at night and talk about ufos etc. because he didn't believe in any of that stuff.  Can't really say if he was referring to Art, tho.

No way in hell Art wins this lawsuit.

I wonder how much in legal fees he is going to have to pay Michael Weiner when it's laughed out of court?

Where are all the Bellgab "legal eagles" who were so vocal when Bell bailed on SXM?  Seemed like half the people on here claimed to be a lawyer, or at least played one on the internet, when the great "no compete" debate was raging.
