Arguable. Prior to the 50's the US Census asked religious question and there was also in the past a "religious census" but all of that was done away with. At the time the concern was Papists and loyalty concerns versus a secular government. So, maybe, it would be legal to put that back in (they ask about race, ethnicity, and MANY other things on the form now.) But I'm not sure what it would accomplish and likely just encourage some jihady to be more angry and act out. I would use the law as currently written I sourced to question immigrants, VISA applicants, etc and, if background checks and "bad answers," either ban/remove them or at least follow them for more info. Gone are the days where we accept bombings and mass shootings because the Muslim was "on our radar" but we don't act because of political-correctness.

I hope, and I hope no one entertains the idea that police cannot be staged inside mosques to see that nothing untoward goes on there.  I don't know of any other house of worship that would find police troubling.
